Exceptions and limitations to the economic right of the author: three step test: approach at international, EU and national

Abstract

The present dissertation approaches the general clause that refers to exceptions and limitations to the economic right of the author, known as “three-step test”. This provision allows states to introduce exceptions and limitations to the economic rights of authors, if the following three conditions are met: exceptions and limitations are only permitted (1) in certain special cases; (2) which do not result in a conflict with the normal exploitation of a work and (3) which do not unreasonably prejudice the legitimate interests of the author (or other right-holder). We are inquiring and suggesting an interpretation of the criteria set by the above-mentioned provision capable of achieving the balance of all the conflicting interests (the interests of the authors, the interests of the rightholders and the public interests) within the field of copyright law.
