Σκοπός της έρευνας αυτής είναι να παρουσιάσει την ύπαρξη της κατάχρησης δεσπόζουσας θέσης στην αγορά των φαρμάκων, λαμβάνοντας υπόψη τις ιδιαιτερότητες της αγοράς αυτής και αναλύοντας σχετικά νομολογιακά παραδείγματα με έμφαση στην υπόθεση της Glaxo (C-468/06-478/06). Επιχειρείται δηλαδή η ανάλυση εφαρμογής του άρθρου 102 ΣΛΕΕ στην αγορά του φαρμάκου, μη παρακάμπτοντας τους κανόνες της εσωτερικής αγοράς της Ε.Ε., με γνώμονα το συμφέρον του καταναλωτή-ασθενή και της δημόσιας υγείας. Αυτό που είναι ιδιαιτέρως σημαντικό είναι η ανάλυση των ορίων εφαρμογής του άρθρου 102 ΣΛΕΕ, έχοντας από τη μια πλευρά την προάσπιση των συμφερόντων των φαρμακευτικών εταιρειών και από την άλλη την ομαλή λειτουργία της αγοράς προς όφελος των καταναλωτών, σε μια αγορά πολύ ιδιαίτερη, όπου σημαντικό ρόλο παίζουν τα κράτη, και τα ασφαλιστικά ταμεία από τη μια και από την άλλη η προάσπιση της έρευνας και της ανάπτυξης της φαρμακοβιομηχανίας. Αρχικά γίνεται μια ανάλυση της αγοράς του φαρμάκου, ώστε να επισημανθούν οι ιδιαιτερότητες της συγκεκριμένης αγοράς. Στην αγορά του φαρμάκου πολύ σημαντικό ρόλο παίζουν η έρευνα και η καινοτομία μια και ο κλάδος των φαρμάκων παρουσιάζει έναν από τους πιο υψηλούς δείκτες επενδύσεων στην Ευρώπη. Κεντρικό στοιχείο για την προώθηση της καινοτομίας αποτελούν τα δικαιώματα πνευματικής ιδιοκτησίας. Ο ρόλος του κράτους και των ασφαλιστικών ταμείων είναι ιδιαίτερα αυξημένος στο χώρο των φαρμάκων, χωρίς να υπάρχει αποτελεσματική πολιτική για περιστολή της φαρμακευτικής δαπάνης με ταυτόχρονη δυνατότητα των ασφαλιστικών ταμείων να ανταποκριθούν στο κόστος. Ερευνάται επίσης, η κατάχρηση της δεσπόζουσας θέσης και το παράλληλο εμπόριο στην αγορά των φαρμάκων. Εδώ υπάρχει σύγκρουση συμφερόντων από τη μια μεταξύ της φαρμακευτικής βιομηχανίας και των χονδρεμπόρων – διανομέων και από την άλλη μεταξύ των κρατών εξαγωγών και των κρατών εισαγωγών με αντίστοιχα επιχειρήματα υπέρ και κατά και των δύο πλευρών. Η αγορά του φαρμάκου έχει πολλές ιδιαιτερότητες με πιο σημαντική τη ρύθμιση των τιμών των φαρμάκων από τα κράτη μέλη. Συνεπώς, η θέσπιση διαφορετικών τιμών από τα κράτη μέλη από τη μια και το γεγονός ότι είναι οι κύριοι αγοραστές των φαρμακευτικών προϊόντων από την άλλη, εγείρει αμφιβολίες σχετικά με την αποτελεσματικότητα του παράλληλου εμπορίου. Κατά δεύτερον, ακόμη και η διανομή των φαρμακευτικών προϊόντων ρυθμίζεται από τα κράτη μέλη, τα οποία θεσπίζουν το σύστημα χορήγησης αδειών για τους χονδρεμπόρους φαρμάκων, κάτι που δημιουργεί πρόσθετες υποχρεώσεις στις φαρμακευτικές επιχειρήσεις και στους χονδρεμπόρους. Τρίτον, οι τελευταίοι έχουν υποχρέωση δημοσίου συμφέροντος να διατηρούν αποθέματα, προκειμένου να διασφαλίζεται η διαθεσιμότητα των φαρμάκων. Συνεπώς, δεν είναι ούτε εύλογη, ούτε ανάλογη η υποχρέωση που επιβάλλεται στις φαρμακοβιομηχανίες να προμηθεύουν, εντός ενός κράτους μέλους στο οποίο οι τιμές είναι χαμηλές, χονδρεμπόρους που προτίθενται να εξαγάγουν τα προϊόντα που προμηθεύτηκαν. Η αλήθεια είναι ότι το ΔΕΕ καθιστά σαφές, πως παρά τις ιδιαιτερότητες κατατάσσει το παράλληλο εμπόριο φαρμάκων ως δικαίωμα απορρέον κατευθείαν από τις διατάξεις της Συνθήκης περί ελεύθερης κυκλοφορίας των εμπορευμάτων, προσπαθώντας παράλληλα να συγκεράσει το δικαίωμα αυτό με τις διατάξεις περί προστασίας των δικαιωμάτων πνευματικής και βιομηχανικής ιδιοκτησίας. Η αποφάσεις σταθμός ώστε να αναδειχθούν όλα τα παραπάνω προβλήματα και να ξεκαθαριστεί η άποψη τόσο της Επιτροπής όσο και του Δικαστηρίου ήταν οι αποφάσεις ΣΥΦΑΙΤ και Λέλος.

These limits are analysed taking into account the sui generis nature of a market shaped to a great extend on the one hand by states and social security institutions, and on the other by the needs of research and development of the pharmaceutical companies. The first part of the study, analyses the market for pharmaceuticals so as to identify the particularities of the market. Research and innovation play a crucial role in this market, with the pharmaceuticals sector showing one of the highest investment indices in Europe. Intellectual property rights are a basic prerequisite for the promotion of innovation. The role of the state and social security institutions is decisive in the pharmaceuticals market, with the need to reduce public spending running counter to the need of social security institutions to cover their costs. The study also addresses the issue of the abuse of dominant position and parallel trade in the pharmaceuticals market. This part of the market witnesses conflicts of interests between the pharmaceutical industry and wholesalers/distributors, as well as between importing and exporting countries, with arguments pro and against each side. The most important of the many particularities of the pharmaceuticals market in the EU is the price setting of pharmaceuticals by member states. The setting of different prices for same products by the member states, while at the same time state institutions are the largest buyers of pharmaceutical products, raises doubts regarding the efficiency of parallel trade. Secondly, even the distribution of pharmaceutical products is regulated by the member states, which issue licences to pharmaceuticals wholesalers, creating additional obligations to both pharmaceutical industries and wholesalers. Thirdly, the latter have the obligation for reasons of public interest to keep stocks so as to secure availability of pharmaceuticals. Therefore, it is neither a reasonable nor a proportionate measure to oblige pharmaceutical industries to supply wholesalers in a low price country with quantities which the wholesalers will eventually export to a higher price country. Nevertheless, the ECJ makes it clear that despite these particularities it considers the parallel trade in pharmaceuticals a right deriving directly from the stipulations of the Convention on the free movement of goods, attempting simultaneously to reconcile this right with the legislation on the protection of intellectual and industrial property. The landmark decision, which brought all the above mentioned issues to the fore and led to a clarification of the views of the Commission as well as the ECJ, was the Syfait and Lelos decision.
