Hotel contract

Abstract

The essay refers to the hotel contract signed between the hotelier and the tour operator by which the tour operator “buys” by the hotelier in advance a large number of beds which afterwards are sold to his own customers, the tourists. Special reference is made to the two basic forms of the hotel contract, according to Article 8 Law 1652/1986 (Regulation of the relations between the hotelier and its customers), i.e the guarantee and the allotment. The essay also refers to the laws applicable to the hotel contract, to form requirements, to its content, to its performance as well as to the breach of the contractual obligations and to the remedies. It moreover deals with issues of international jurisdiction of the Greek courts and of private international law. The essay attempts both to systematize the issues arising from the operation of the hotel contract and to provide with a safe legal framework for the regulation of the above issues.
