Internationale standards für das jugendstrafrecht und ihre verwirklichung in Deutschland und in Griechenland

Abstract

This study aims to present the international human rights standards for juvenile delinquents in a systematic way and furthermore to examine the question of whether and to what extent these standards are implemented in Germany and in Greece. The focus is on the comparative intercultural aspects of the thesis, highlighting the need for a deeper understanding and a more efficient implementation of children’s human rights in both countries.In the first part, emphasis is on the history of children's rights in the 20th and 21st centuries. The systems of the League of Nations, the United Nations and the Council of Europe as well as the system of the European Union for the treatment of juvenile offenders are presented and the most important legislative binding and non-binding instruments in juvenile criminal law at the level of the United Nations and the Council of Europe are elaborated. In the main part, the international human rights standards for young offenders are presented in more detail. By systematizing and categorizing the international legal norms concerning juvenile criminal law, the most important principles of juvenile criminal law are derived. Furthermore, whether and to what extent these principles are applied, both legally and practically, in Germany and in Greece is analyzed. According to the international human rights standards, an independent juvenile justice system shall be established so that it can serve the aims of the social integration and education of juvenile offenders. The commission of criminal offenses is a prerequisite for the application of juvenile criminal law and status offenses are excluded. The minimum age of criminal responsibility should not be set very low and basic procedural rights must be guaranteed. The least repressive intervention in the sense of diversion and educational measures has priority and deprivation of liberty should be imposed as a last resort and for the shortest possible duration. If imprisonment cannot be avoided, the treatment of juvenile offenders in detention centers must be humane and promote the juvenile offenders’ education and social integration over the long term. Under the influence of international standards in recent decades, German and Greek juvenile criminal law has become more progressive and modernized, but further improvements in both legal systems are required.In the final part, the core idea of this work is explained. The international standards for juvenile criminal law represent basic guarantees of the most important human rights for young offenders and form the basis for a decent life. Their aim is the establishment of a humane, just and rational system of juvenile criminal justice, which will facilitate the young offenders’ social integration with the consideration for the victims’ interests and the promotion of peaceful coexistence.

Αυτή η μελέτη στοχεύει να παρουσιάσει τα διεθνή πρότυπα ανθρωπίνων δικαιωμάτων για τους ανήλικους παραβάτες με συστηματικό τρόπο και επιπλέον να εξετάσει το ερώτημα εάν και σε ποιο βαθμό αυτά τα πρότυπα εφαρμόζονται στη Γερμανία και στην Ελλάδα. Η εστίαση είναι στις συγκριτικές διαπολιτισμικές πτυχές της διατριβής, τονίζοντας την ανάγκη για βαθύτερη κατανόηση και αποτελεσματικότερη εφαρμογή των ανθρωπίνων δικαιωμάτων των παιδιών και στις δύο χώρες.Στο πρώτο μέρος, έμφαση δίνεται στην ιστορία των δικαιωμάτων του παιδιού τον 20ο και τον 21ο αιώνα. Παρουσιάζονται τα συστήματα της Κοινωνίας των Εθνών, των Ηνωμένων Εθνών και του Συμβουλίου της Ευρώπης καθώς και το σύστημα της Ευρωπαϊκής Ένωσης για τη μεταχείριση των ανηλίκων παραβατών και αναλύονται τα σημαντικότερα νομοθετικά δεσμευτικά και μη δεσμευτικά κείμενα του ποινικού δικαίου ανηλίκων στο επίπεδο των Ηνωμένων Εθνών και του Συμβουλίου της Ευρώπης. Στο κύριο μέρος, παρουσιάζονται αναλυτικότερα τα διεθνή πρότυπα ανθρωπίνων δικαιωμάτων για τους νεαρούς παραβάτες. Με τη συστηματοποίηση και κατηγοριοποίηση των διεθνών νομικών κανόνων που αφορούν το ποινικό δίκαιο ανηλίκων, προκύπτουν οι σημαντικότερες αρχές του ποινικού δικαίου των ανηλίκων. Επιπλέον, αναλύεται εάν και σε ποιο βαθμό αυτές οι αρχές εφαρμόζονται, τόσο νομικά όσο και πρακτικά, στη Γερμανία και στην Ελλάδα. Σύμφωνα με τα διεθνή πρότυπα ανθρωπίνων δικαιωμάτων, πρέπει να δημιουργηθεί ένα ανεξάρτητο σύστημα δικαιοσύνης ανηλίκων ώστε να μπορεί να εξυπηρετεί τους σκοπούς της κοινωνικής ένταξης και της διαπαιδαγώγησης ανηλίκων παραβατών. Η διάπραξη ποινικών αδικημάτων αποτελεί προϋπόθεση για την εφαρμογή του ποινικού δικαίου ανηλίκων και εξαιρούνται οι παραβάσεις-status. Το ελάχιστο όριο ηλικίας ποινικής ευθύνης δεν πρέπει να οριστεί πολύ χαμηλό και πρέπει να διασφαλιστούν τα βασικά δικονομικά δικαιώματα. Η λιγότερο κατασταλτική παρέμβαση με την έννοια της αποχής από τη δίωξη και της επιβολής εκπαιδευτικών μέτρων έχει προτεραιότητα και η στέρηση της ελευθερίας θα πρέπει να επιβληθεί ως έσχατη λύση και για τη συντομότερη δυνατή διάρκεια. Εάν η φυλάκιση δεν μπορεί να αποφευχθεί, η μεταχείριση των ανηλίκων παραβατών στα κέντρα κράτησης πρέπει να είναι ανθρώπινη και να προάγει την εκπαίδευση και την κοινωνική ένταξη των ανηλίκων μακροπρόθεσμα. Υπό την επίδραση των διεθνών προτύπων τις τελευταίες δεκαετίες, το γερμανικό και το ελληνικό ποινικό δίκαιο για ανήλικους έχει καταστεί πιο προοδευτικό και εκσυγχρονισμένο, αλλά απαιτούνται περαιτέρω βελτιώσεις και στα δύο νομικά συστήματα.Στο τελευταίο μέρος, εξηγείται η βασική ιδέα αυτής της εργασίας. Τα διεθνή πρότυπα για το ποινικό δίκαιο ανηλίκων αντιπροσωπεύουν βασικές εγγυήσεις των πιο σημαντικών ανθρωπίνων δικαιωμάτων για τους νεαρούς παραβάτες και αποτελούν τη βάση για μια αξιοπρεπή ζωή. Στόχος τους είναι η εγκαθίδρυση ενός ανθρώπινου, δίκαιου και ορθολογικού συστήματος ποινικής δικαιοσύνης ανηλίκων, το οποίο θα διευκολύνει την κοινωνική ένταξη των νεαρών παραβατών σε εναρμόνιση με το σεβασμό των συμφερόντων των θυμάτων και την προώθηση της ειρηνικής συνύπαρξης.

Die Studie hat die systematische Darstellung der internationalen Menschenrechtsstandards für junge Straftäter und die Frage nach ihrer gesetzlichen und praktischen Umsetzung in Deutschland und in Griechenland zum Gegenstand. Der Schwerpunkt liegt auf der Schilderung der Standards sowie auf dem Vergleich der zwei Rechtsordnungen aus Sicht dieser Standards. Hervorgehoben wird die Notwendigkeit eines tieferen Verständnisses und einer effizienteren Umsetzung der Menschenrechte von Kindern in den beiden untersuchten Ländern. Im ersten Teil der Abhandlung wird die Geschichte der Kinderrechte im 20. und im 21. Jahrhundert dargestellt. Die Systeme des Völkerbundes, der Vereinten Nationen und des Europarates sowie der Europäischen Union zur Regulierung der Behandlung von straffälligen Jugendlichen werden untersucht und die wichtigsten internationalen Regelwerke zum Jugendstrafrecht auf der Ebene der Vereinten Nationen und des Europarates werden analysiert. Im Hauptteil werden die internationalen Menschenrechtsstandards für junge Straftäter vertiefend dargestellt. Aus einer Systematisierung und Kategorisierung der internationalen Rechtsnormen zum Jugendstrafrecht werden die wichtigsten Prinzipien des Jugendstrafrechts abgeleitet. Des Weiteren wird überprüft, ob und inwiefern diese Prinzipien in Deutschland und in Griechenland sowohl gesetzlich umgesetzt sind als auch praktisch angewendet werden. Laut den internationalen Standards soll eine spezialisierte Jugendgerichtsbarkeit bestehen, die den Zielen der sozialen Integration und Erziehungsförderung dient. Die Begehung von Straftaten ist Voraussetzung für die Anwendung des Jugendstrafrechts und Statusdelikte, d.h. Delikte, die nur als Straftaten definiert werden, wenn sie von Kindern begangen werden, soll es nicht geben. Das Mindestalter der Strafmündigkeit soll nicht zu niedrig angesetzt werden und grundlegende Verfahrensgarantien sind zu gewährleisten. Der am wenigsten repressiven Intervention im Sinne des Absehens von der Strafverfolgung und der Anwendung von ambulanten Maßnahmen ist Vorrang gegenüber freiheitsentziehenden Maßnahmen einzuräumen, welche nur als letztes Mittel und für die kürzest mögliche Dauer verhängt werden sollen. Falls die Inhaftierung nicht vermieden werden kann, ist die Behandlung im Jugendstrafvollzug menschenwürdig und erziehungsorientiert zu gestalten. Unter dem Einfluss der internationalen Standards sind das deutsche und das griechische Jugendstrafrecht in den letzten Jahrzehnten fortschrittlicher und moderner geworden, jedoch sind weitere Verbesserungen in beiden Rechtssystemen erforderlich. Im Schlussteil wird der Kerngedanke dieser Studie erläutert. Dieser besteht darin, dass die internationalen Standards für das Jugendstrafrecht zentrale Menschenrechtsgarantien für junge Straftäter darstellen und die Grundlage für ein menschenwürdiges Leben bilden. Ihr Ziel ist die Ausgestaltung eines humanen, gerechten und rationalen Jugendstrafjustizsystems zur Erleichterung der sozialen Integration der jungen Täter im Einklang mit der Berücksichtigung der Opferinteressen und der Förderung des friedlichen Zusammenlebens.
