Οι μικτές συμφωνίες αποτελούν αναμφίβολα ένα από τα πιο σημαντικά και περίπλοκα πεδία του δικαίου των εξωτερικών σχέσεων της Ευρωπαϊκής Ένωσης. Η διαπραγμάτευση, η σύναψη και η εφαρμογή τους δημιουργούν ενδιαφέροντα νομικά και πρακτικά ζητήματα, που σχετίζονται με την αρμοδιότητα, την δικαιοδοσία, τη διεθνή ευθύνη και συχνά προβληματίζουν τους ειδικούς σε χώρες και οργανισμούς με τους οποίους συνεργάζεται η Ένωση. Στόχος της μελέτης αυτής είναι η αποσαφήνιση των προβλημάτων που προκύπτουν από την μικτή διαδικασία. Με τον όρο «μικτές συμφωνίες» εννοούμε τις συμφωνίες εκείνες στις οποίες είναι συμβαλλόμενα μέρη η Ένωση, τα Κράτη μέλη της και ένα ή περισσότερα τρίτα Κράτη και περιλαμβάνουν διατάξεις, μερικά στοιχεία των οποίων εμπίπτουν στην αρμοδιότητα της Ένωσης και μερικά στην αρμοδιότητα των Κρατών μελών της.Η ασαφής κατανομή των αρμοδιοτήτων της Ένωσης και των Κρατών μελών στο πεδίο των εξωτερικών σχέσεων προκαλεί προβλήματα σε όλα τα στάδια σύναψης των μικτών συμφωνιών και δημιουργε ...

Η διαπραγμάτευση, η σύναψη και η εφαρμογή τους δημιουργούν ενδιαφέροντα νομικά και πρακτικά ζητήματα, που σχετίζονται με την αρμοδιότητα, την δικαιοδοσία, τη διεθνή ευθύνη και συχνά προβληματίζουν τους ειδικούς σε χώρες και οργανισμούς με τους οποίους συνεργάζεται η Ένωση. Στόχος της μελέτης αυτής είναι η αποσαφήνιση των προβλημάτων που προκύπτουν από την μικτή διαδικασία. Με τον όρο «μικτές συμφωνίες» εννοούμε τις συμφωνίες εκείνες στις οποίες είναι συμβαλλόμενα μέρη η Ένωση, τα Κράτη μέλη της και ένα ή περισσότερα τρίτα Κράτη και περιλαμβάνουν διατάξεις, μερικά στοιχεία των οποίων εμπίπτουν στην αρμοδιότητα της Ένωσης και μερικά στην αρμοδιότητα των Κρατών μελών της.Η ασαφής κατανομή των αρμοδιοτήτων της Ένωσης και των Κρατών μελών στο πεδίο των εξωτερικών σχέσεων προκαλεί προβλήματα σε όλα τα στάδια σύναψης των μικτών συμφωνιών και δημιουργεί αβεβαιότητα στα αντισυμβαλλόμενα μέρη της συμφωνίας κυρίως ως προς το ζήτημα της ευθύνης. Η ex ante οριοθέτηση των αρμοδιοτήτων της Ένωσης και των Κρατών μελών ή η υιοθέτηση ενός κανόνα κοινής ευθύνης δεν αποτελούν ιδανική λύση, ενώ αντιθέτως θα πρέπει να επιτραπεί στην Ένωση και στα Κράτη μέλη να αποφασίσουν κατά περίπτωση για την απόδοση της ευθύνης. Από την άλλη μεριά, οι διαφορές που προκύπτουν από τις μικτές συμφωνίες μεταξύ των Κρατών μελών και /ή των οργάνων της Ένωσης απονέμουν πάντα αποκλειστική αρμοδιότητα στο ΔΕΚ. Ενδιαφέρον ζήτημα αποτελεί, εξάλλου, η εκπροσώπηση της Ένωσης και των Κρατών μελών κατά την διαπραγμάτευση και την υπογραφή των μικτών συμφωνιών, ενώ συγχρόνως, καθίσταται επιτακτική η ανάγκη για συντονισμό των ενεργειών της Ένωσης και των Κρατών μελών καθώς και η υποχρέωση στενής συνεργασίας. Γεγονός είναι ότι οι μικτές συμφωνίες που συνάπτονται κατά παραβίαση του δικαίου της Ευρωπαϊκής Ένωσης δεν είναι ipso facto άκυρες. Η ισχύς των μικτών συμφωνιών στην κοινοτική έννομη τάξη, η ισορροπία των δικαιωμάτων και των υποχρεώσεων που δημιουργούνται στα πλαίσια μίας μικτής συμφωνίας, η αρχή της εναλλαγής, το ζήτημα της ψήφου, το άμεσο αποτέλεσμα των διατάξεων μίας μικτής συμφωνίας, ο ρόλος του ΔΕΚ στην ερμηνεία των μικτών συμφωνιών είναι ζητήματα που προβληματίζουν τους μελετητές της μικτής διαδικασίας και αναμφισβήτητα επηρεάζουν την σωστή λειτουργία του «συστήματος» των μικτών συμφωνιών στην κοινοτική έννομη τάξη.

The unclear division of competences between the EU and its Member States, in the area of external relations, causes problems in all stages of negotiation and conclusion of a mixed agreement and creates uncertainty to the contracting parties, mainly on liability issues. The ex-ante delimitation of competences between the EU and its Member States, or the adoption of a common responsibility rule is not the ideal solution; on the contrary, the EU and its Member States should be allowed to decide on attribution of liability as the case may be. On the other hand, the differences arising from mixed agreements between the Member States and/or the Institutions of the EU confer always exclusive jurisdiction on the ECJ. Another interesting issue is the representation of the European Union and the Member States during the negotiation and signing of mixed agreements, while, at the same time, there is a vital need for coordination and close cooperation between the EU and its Member States. It is a fact is that mixed agreements concluded in breach of EU law are not void ipso facto. The validity of mixed agreements in the Community legal order, the balance between rights and responsibilities arising under a mixed agreement, the principle of rotation, the issue of voting, the direct effect of provisions of a mixed agreement, the role of the ECJ in the understanding of mixed agreements are questions that puzzle those who study the mixed procedure and, undoubtedly, affect the proper operation of the "system" of mixed agreements in the Community legal order.
